Privacy, confidentiality, and taking care of others’ personal data is paramount for PhageLab Chile SpA (hereinafter “PhageLab”). Therefore, we are committed to ensuring the protection of your personal data, and to respecting your privacy.
This Personal Information Privacy Policy is based on PhageLab’s commitment to information privacy and safety with regards to our clients’ and users’ personal data; and is founded on the principles of confidentiality, proportionality, integrity, transparency, availability, and applicable legal obligations.
Below you will find the manner in which PhageLab recollects, treats, and protects personal information that you provide, or that PhageLab obtains through its website https://phage.lab.com (hereinafter the “Site”), other websites that may have been implemented and that may be implemented in the future, forms, and other PhageLab channels of communication.
This policy does not apply to data that is gathered by third parties using other applications, or websites, even when these are embedded on the Site. In said case, they are to be within the norm of said websites’ privacy policies.
The processing of personal information performed by PhageLab shall be done pursuant to Law 19.628 “Law on the Protection of Private life”, and to the rest of the norms related to safeguarding, protecting, reserving, and maintaining personal data.

a) “Personal information”: Any information linked to, or in reference to an identified or identifiable natural person, through means that may be reasonably employed;
b) “Sensitive personal information”: All information that refers to the physical or moral characteristics of a person or to facts or circumstances related to their private life or intimacy, such as personal habits, race origin, ideologies, beliefs, political opinions and sexual life.
c) “Processing of information” or “Data treatment”: Any operation or series of operations or procedures whether technical, automated, or otherwise, that may allow for the collection, storage, recording, organization, elaboration, selection, extraction, confrontation, interconnection, disassociation, communication, assignment, transfer, transmission or cancelation of personal data, or to use the same in any other manner.
d) “Responsible for processing”: The legal entity or natural person, whether private or public, that decides on the processing of information; that is to say, the person that makes decisions on what is done with the same from its capture to elimination of the same. For intents and purposes of this privacy policy, PhageLab acts as the one responsible for the processing of information.
e) “Commissioned to process information”: The natural person or legal entity that processes personal information on the part of the Responsible party (Responsible for processing), as a consequence of the existence of a legal relationship binding the same to the Responsible party.
f) “User”: The natural person that enters, or uses, the Site and that expressly authorizes the processing of his/her personal information on the part of PhageLab or that in any other way, expressly authorizes the processing of their personal information on the part of PhageLab.
g) “Owner of personal information”: The natural person whose personal information is the object of processing, and that PhageLab is responsible for according to circumstances.
h) “Transfer of information”: Occurs when the party responsible for or in charge of processing personal information, located in Chile, sends information or personal information to a receptor, who is in turn responsible for the processing thereof, and is located within, or outside, of the country.
i) “Transmission of information”: Processing of personal information that implies the communication of these within, or outside of the country, with the objective of processing the information by the person responsible for it.

The processing of personal information performed by PhageLab, is founded on the execution of a contract, compliance of a legal obligation, express, prior, unequivocal, free and informed consent of the owner, under law, and/or in light of legitimate interest, whatever the case may be.

PhageLab shall process the information that is strictly necessary for the fulfillment of the following purposes:

1. Managing its registration, requests and interactions as a Site User.
2. To manage the contractual relationship derived from the execution of services enabled on the Site.
3. Managing requests received through the contact form on the Site, or under the intent of registering for our newsletter.
4. Performing all necessary actions for confirming and updating User’s information, including identity validation upon performing operations with PhageLab, and the analysis of User’s profile information. For this, PhageLab may use your information to safeguard the security of your information.
5. For commercial or advertising ends, to promote and offer the possibility of carrying out Services requests on the Site, and to keep you informed on the functionality of the Site.
6. Analyzing Users’ behavior during Site navigation.
7. For compliance of legal obligations.
8. With the purpose of maintaining quality of services, verifying instructions, and preventing fraud.
9. Finally, information may be used for statistical, historical, and research purposes among others; in which case, and when possible, your information will be used in an anonymized manner; that is to say, not being able to identify the identity of the person to whom said information belongs.

For said intents and purposes, PhageLab may collect your information through various means, such as the access and use of the Site, remission of online forms, electronic mail, telephone calls, and online chats, among other authorized channels, under current legislation.

As a general rule, PhageLab shall not share your personal information with third parties, unless there is a legal mandate that allows it, as well as in those cases in which you consent to do so.
Notwithstanding the foregoing, through acceptance of this Privacy Policy, you hereby authorize PhageLab so that the same may share and communicate your personal information in the following circumstances:

1. With third-party SPs that are exclusively related to services enabled on the Site. Said providers may access your personal information as one Commissioned to Process information; that is to say, to handle your information on behalf of PhageLab. For this, PhageLab has adopted criteria for the selection of service providers so that the latter may provide their services fully complying with information protection policies defined by PhageLab, both regarding matters of confidentiality, as well as the safeguarding of information, and cybersecurity, among others.
2. To process requests executed by Users and that fully comply with agreed upon obligations.
3. To contribute to the prevention of fraud, or to comply with or protect the rights and properties of PhageLab, or of PhageLab’s clients.
4. To protect the personal safety of PhageLab employees, third-party representatives or the general public.
5. To comply with any law, regulation, citation, or court order.
6. For the cases in which, and for strategic or other purposes, PhageLab should decide to sell, purchase, merge, or reorganize its business in another manner. In said case, said transaction may include divulging personal information to real buyers, or the reception of the same on the part of sellers. PhageLab maintains, as a norm, the adequate protection of personal information for these kinds of transactions.

In all of these cases, whoever is Commissioned to process personal information must be in full compliance with this privacy policy.

Through the acceptance of this privacy policy, the titular expressly authorizes PhageLab to communicate and/or transfer their personal information to servers located in the cloud and/or on foreign soil, and to any other remaining parts of contracted services that may be located in different jurisdictions.

The personal information belonging to the titular/s of this privacy policy shall be kept during the time deemed necessary in relation to the previously indicated purposes, save for those cases in which, by way of legal or regulatory provision, the same is to be maintained for longer periods of time than those set forth in this term; in which case, the information will be maintained for the time indicated in this provision.

Owners of Personal Information shall have the following rights:

Right to access: The owners of information may request from PhageLab, information on whether their information is being processed by them, and to access said information in said case.
Right to rectification: The owners of information may request PhageLab to modify or amend their Personal Information, whenever it may be inexact, not updated, incomplete, or should the same induce error.
Right to cancellation: The owners of information may request from PhageLab, the suppression or elimination of their personal information when consent has been revoked for its processing, and should there no longer be licit grounds for processing, when processing may be illicit, or when information may be outdated.
Right to objection: Means the right the owner has to request, from PhageLab, to not process determined information.

If you are a person who is a physical resident of the European Union, PhageLab declares that your personal information is stored in files belonging to PhageLab, guaranteeing its integrity, confidentiality, and security. For this, standards of protection security for your personal information adopted by PhageLab, are in accordance with the General Data Protection Regulation (EU Regulation 2016/679) dated April 27th 2016, related to the protection of physical persons with respect to the processing of personal information and the free circulation of said information, and which derogates Directive 95/46/CE (General Data Protection Regulation); and that the same has established all technical measures within reach to avoid loss, misuse, alteration, unauthorized access, and theft of information that you may provide to us. Notwithstanding, the internet security measures are not expungable; therefore, PhageLab does not assume any responsibility for harm or damages derived from the alterations that third parties may make in their information systems, electronic documents or files. Notwithstanding, it is expressly set forth that the internet security measures are not expungable; therefore, PhageLab does not assume any responsibility for harm or damages derived from the alterations that third parties may make in their information systems, electronic documents, or files.
